CEILING COLLAPSE

A common problem for New York City residents is cracked, peeling, or bubbling ceilings. This is problematic because what appears to just be a cosmetic condition is actually a disaster waiting to happen. Many times these conditions are caused by leaking pipes or flooding from above. The water damages caused by these conditions can eventually lead to the ceiling collapsing and eventually injury innocent victims below.





Although a ceiling collapse is usually preventable, many times complains to building owners, superintendents and porters of buildings get ignored. At that point, the ceiling becomes a ticking time bomb in which the ceiling can collapse at any time. Falling debris due from a collapsing ceiling may strike an innocent person below resulting in injuries including to the neck, head and other parts of the body.

It is the responsibility of the landlord or the building manager of the building to provide a safe environment for their tenants. They are responsible for inspecting the premises for unsafe conditions and quickly responding to dangerous conditions once complaints are made. Their failure to do so is negligent and they will be liable for any injury their tenants sustains.

Some examples of landlord’s and manager’s carelessness that can lead to a ceiling collapse include:

  • Failure to respond to tenant’s complaints
  • Failure to inspect apartments below when a leak, flood, or other water damage from an apartment or floor above.
  • Not removing ice or snow from the roof
  • Negligently repairing a condition which is likely to lead to a ceiling collapse
